DISCLOSURES OF INTEREST

(Members Code of Conduct - Part 4A of the Constitution)

 

To receive disclosures of interests from members and co-opted members on matters to be considered at the meeting. The disclosure must include the nature of the interest.

 

An interest must also be disclosed in the meeting when it becomes apparent to the member during the meeting.

 

Notes:

 

(1)       Members may remain in the meeting and take part fully in discussion and voting unless the interest is a disclosable pecuniary interest or an interest which the Member feels would call into question their compliance with the wider principles set out in the Code of Conduct.  Disclosable pecuniary interests relate to the Member concerned or their spouse/partner.

 

(2)       Members in arrears of Council Tax by more than two months must not vote in decisions on, or which might affect, budget calculations, and must disclose at the meeting that this restriction applies to them.  A failure to comply with these requirements is a criminal offence under section 106 of the Local Government Finance Act 1992. 

 

(3)       Members are also welcome to disclose interests which are not disclosable pecuniary interests but which they consider should be made in the interest of clarity.

 

(4)       Officers must disclose interests in accordance with Council Standing Order 44.

Reports and background papers for agenda items may be inspected by contacting the person shown after each agenda item.  Certain reports and background papers may be restricted. 

 

Any request to remove the restriction on a report or background paper should be made to the relevant Strategic Director or Assistant Director whose name is shown on the front page of the report. 

 

If that request is refused, there is a right of appeal to this meeting.

APPLICATION FOR A PREMISES LICENCE IN RESPECT HORSFALL COMMUNITY STADIUM, HORSFALL STADIUM, CEMETERY ROAD, LOW MOOR, BRADFORD, BD6 2JZ pdf icon PDF 166 KB

The Interim Assistant Director Waste, Fleet and Transport Services will present a report (Document “Z”) which outlines an application for the grant of a premises licence for the sale of alcohol for consumption on and off the premises, the provision of regulated entertainment indoors and outdoors and the provision of late night refreshment indoors and outdoors in respect Horsfall Community Stadium, Horsfall Stadium, Cemetery Road, Low Moor, Bradford, BD6 2JZ.

That having considered all valid representations made by the parties to the hearing; valid written representations received during the statutory period, the published statement of licensing policy and relevant statutory guidance; the panel grants the application subject to the following amendments -

 

1.    Supply of alcohol for consumption ON premises and the provision of regulated entertainment indoors be carried out Sunday – Thursday 11:00 till 23:00 Friday and Saturday 11:00 till 00:00 (midnight)

 

2.   The License Holder shall consult with West Yorkshire Police 3 months prior to planning an event that is unusual in character. (Amendment to Condition (b) 2 of the Operating Schedule.

 

3.   Outdoor entertainment to cease at 22:30

 

Reason – So as to promote the Crime and Disorder and the Prevention of Public Nuisance licensing objectives of the Licensing Act.

The Interim Assistant Director, Waste, Fleet and Transport Services presented a report (Document “Z”) outlining an application for the grant of premises licence for the sale of alcohol for consumption on and off the premises, the provision of regulated entertainment indoors and outdoors and the provision of late night refreshment indoors and outdoors in respect Horsfall Community Stadium, Horsfall Stadium, Cemetery Road, Low Moor, Bradford, BD6 2JZ.

 

The Licensing Officer advised the Panel that the application was for supply of alcohol for consumption on and off premises indoors and outdoors Monday to Saturday 10.00 to 01.30 and Sunday 10.00 to 00.00

The application was also for playing of recorded music indoors and outdoors, Monday to Sunday 10.00 to 01.30 and performance of live music indoors and outdoors Monday to Sunday 10.00 to 00.00. Performance of plays/exhibition of films/indoor sporting events/boxing or wrestling entertainment/performance of dance/anything similar indoors and outdoors Sunday to Thursday 10.00 to 23.00 Friday and Saturday 10.00 to 00.00.

 

Members were advised that thirteen letters of representation, including two from Ward Councillors had been received, raising concerns regarding noise nuisance seven days a week until late at night. Concerns were also raised regarding litter problems, glass and broken bottles left in surrounding areas.

 

The Applicant addressed the meeting and reported that after carrying out consultations with local residents and elected members, Horsfall Community Stadium has agreed to the following amendments on the application for a premises licence.

 

1.    Withdrawal of the request for off premises sale of alcohol

2.    Supply of alcohol on premises to be the same times stated on the existing premises licence.

3.    Opening times of the premises to be 09.00

4.    All outdoor events restricted to 22.30

5.    Late night refreshments from 09.00to stop at the stated times for supply of alcohol.

6.    Amended opening times Sunday to Thursday 09.00 to 23.30 Friday and Saturday 09.00 to 00.30 – alcohol served from 11.00.

 

The Applicant provided details on all the events, clubs and sessions currently taking place at the Stadium. The Applicant advised that the number of footfall has increased and continues to do so. The car park will be improved and many other improvements have been carried out at the Stadium such as, new LED foot lighting, new toilets etc.

 

The Applicant went on to explain how the young people attending the Stadium help with litter picking, as this has been identified as an issue in previous communications with local residents. Local residents were assured all future events would be held in a satisfactory manner to all.

 

Local residents and a Ward Councillor who had submitted representations were also in attendance and provided a summary of issues and concerns.
