DISCLOSURES OF INTEREST

(Members Code of Conduct - Part 4A of the Constitution)

 

To receive disclosures of interests from members and co-opted members on matters to be considered at the meeting. The disclosure must include the nature of the interest.

 

An interest must also be disclosed in the meeting when it becomes apparent to the member during the meeting.

 

Notes:

 

(1)       Members may remain in the meeting and take part fully in discussion and voting unless the interest is a disclosable pecuniary interest or an interest which the Member feels would call into question their compliance with the wider principles set out in the Code of Conduct.  Disclosable pecuniary interests relate to the Member concerned or their spouse/partner.

 

(2)       Members in arrears of Council Tax by more than two months must not vote in decisions on, or which might affect, budget calculations, and must disclose at the meeting that this restriction applies to them.  A failure to comply with these requirements is a criminal offence under section 106 of the Local Government Finance Act 1992. 

 

(3)       Members are also welcome to disclose interests which are not disclosable pecuniary interests but which they consider should be made in the interest of clarity.

 

(4)       Officers must disclose interests in accordance with Council Standing Order 44.

 

Minutes:

In the interests of transparency, Councillor Davies declared a non-pecuniary interest in this item on the basis that her son was employed by a bookmaking organisation.

PROPOSED STATEMENT OF LICENSING PRINCIPLES 2022-2024 UNDER THE GAMBLING ACT 2005, FOR APPROVAL BY FULL COUNCIL pdf icon PDF 173 KB

The report of the Assistant Director Waste, Fleet & Transport Services (Document “A”) sets out the outcome of a public consultation exercise with respect to the Statement of Licensing Principles for the District, as required by the Gambling Act 2005 and proposes a final draft for recommendation for adoption by Council.

 

Recommended -

 

(1)       That the Committee recommends to Council that the document attached in Appendix 1 to Document “A” be adopted and published as the District’s Statement of Licensing Principles pursuant to the Gambling Act 2005 (subject to any amendments that the Committee feels is appropriate).

 

(2)       That the Interim Assistant Director Waste, Fleet & Transport Services be given delegated authority to approve any necessary amendments of a minor or drafting nature prior to formal publication.

Minutes:

The report of the Assistant Director Waste, Fleet & Transport Services (Document “A”) set out the outcome of a public consultation exercise with respect to the Statement of Licensing Principles for the District, as required by the Gambling Act 2005 and proposed a final draft for recommendation for adoption by Council.

 

The proposed final draft policy document was appended to the report.

 

The report revealed that the consultation draft of the statement of licensing principles for 2022-2024, was available for public comment from 29 October 2021 to 5 December 2021 The draft document was available on the Council’s website and in public libraries. Licensing officers also directly consulted relevant authorities and organisations.

           

It was explained that the policy document sought to reflect very detailed and substantial statutory guidance issued by the Gambling Commission under the Act.  That guidance set the parameters of what could and what should not be included within local statements of licensing principles.

 

The main additions to the policy document were reported as follows:

 

Section 1

 

Information about the district had been updated and reference to the Bradford Council Plan 2021-2025 had been added.

 

Section 8

             

Public Health and Gambling had been added.

 

The Interim Assistant Director, Waste, Fleet and Transport Services reported all public consultation responses and corresponding officer comments.

 

It was explained that it was not possible to approve a suggestion from Public Health that a representative from that organisation sit on the Bradford District Licensing Panel when gambling premises were being discussed.  Whilst Public Health was not a responsible authority It had been agreed that officers would be advised of future applications. 

 

Members were aware that a motion on Gambling had been discussed by Council at the meeting on 25 January 2022 and the resolution of that meeting was considered.

 

The Chair thanked the Council’s Legal advisor, who would be retiring shortly, for all his help and assistance during his tenure as Chair of the meeting.  All Members wished him well for the future.
